1. Who We Are

These Terms apply to the Function Labs website operated by Function Labs Limited, a private limited company registered in England and Wales under company number 17129741. Function Labs builds and operates its own digital products and provides professional software and development services to customers internationally.

2. Scope of These Terms

These Terms cover use of this website, including:

• submitting enquiries, support requests and product-interest or waitlist forms;
• information about Function Labs products, including Gravity by Function Labs and its modules;
• information about Base44 reviews, fixes, development and launch support;
• information about website design, app/MVP development, business software and repair services; and
• links from this website to Function Labs products, app stores, Steam and other third-party services.

Individual Function Labs products may have their own terms, privacy notices, subscription terms or licence terms. Professional projects and business software engagements are governed by the accepted quotation, statement of work, order form or other written agreement. Where those documents conflict with this page, the specific written agreement takes precedence for that product or project.

3. Website Information

Website content, product descriptions, status labels, indicative pricing and service information are provided to help you understand our products and services. Unless expressly stated otherwise, they are not a binding quotation, specification, guarantee or commitment to deliver a particular outcome. Features, availability and pricing may change as products are developed and services evolve.

4. Enquiries, Quotations and Project Agreements

• Submitting an enquiry does not create a binding contract.
• A professional-services project starts only when the relevant quotation, scope or other written agreement has been accepted in the manner specified.
• The project document will set out the agreed scope, price, payment schedule, dependencies and any project-specific terms.
• Work outside the agreed scope may require a change request, revised quotation or additional charge.
• Third-party fees such as hosting, domains, app-store fees, Base44 plan charges, API usage or external services are not included unless expressly stated.

5. Your Responsibilities on Professional Projects

Where you engage Function Labs for professional work, you are responsible for:

• providing accurate information, timely feedback and the access reasonably needed to perform the agreed work;
• ensuring you have permission to provide any content, data, systems or third-party accounts you ask us to work with;
• reviewing material decisions, approvals and deliverables within agreed timescales; and
• not sending passwords, payment-card details or other unnecessary secrets through ordinary enquiry or support forms.

6. Timelines and Third-Party Dependencies

Delivery dates depend on the agreed scope, timely customer input and third-party platforms or services. Base44, app stores, payment providers, APIs, hosting providers and other external services can change their functionality, policies or availability without Function Labs controlling those changes. We will make reasonable efforts to meet agreed timelines, but delays caused by missing customer input or third-party dependencies may require the schedule to change.

7. Fees, Payments, Cancellations and Refunds

The price and payment terms for professional work are set out in the relevant quotation or order. Product purchases and subscriptions may be processed by third-party payment providers or app stores and can also be subject to their purchase and refund rules. Nothing in these Terms removes any statutory rights that cannot lawfully be excluded. Any project-specific cancellation, deposit or refund terms in an accepted quotation or order take precedence for that engagement.

8. Gravity by Function Labs

Gravity is a modular workforce operating system that may be supplied as a complete platform or through individual Gravity modules. Business access, selected modules, implementation, pricing, support arrangements and any data-processing terms are agreed with the customer in the relevant commercial documents. Gravity may provide HR guidance and workflow support, but Function Labs is not a law firm and Gravity is not a substitute for qualified employment-law or other professional advice where that is required.

9. Base44 Services and Independence

Function Labs participates independently in the Base44 Partner Program, has reached Architect level, and offers reviews, troubleshooting, development and related services for applications built on Base44. Function Labs is not Base44, is not employed by Base44 and does not speak on Base44's behalf. Base44 platform decisions, outages, plan limits, product changes and approvals remain outside Function Labs' control.

10. App Stores and Marketplaces

Function Labs cannot guarantee approval, ranking, availability or continued listing on Apple's App Store, Google Play, Steam or any other marketplace. Marketplace owners make their own decisions and may change policies or technical requirements. Where launch support is included, we will work to prepare the product for submission but do not guarantee approval.

11. Intellectual Property

• Function Labs' own product names, branding, logos, source materials and proprietary technology remain the property of Function Labs Limited or the relevant rights holder.
• Ownership and licensing of bespoke project deliverables are governed by the accepted project terms.
• You retain responsibility for ensuring material you supply to us can lawfully be used for the project.
• Nothing on this website grants a right to copy or use Function Labs branding or proprietary materials without permission.

12. Confidentiality and Data

Where professional work requires access to non-public customer information, we will use it for the agreed work and handle it with reasonable care. Data-protection responsibilities, including any controller/processor arrangements for systems such as Gravity or customer applications, may be set out in a separate data-processing agreement or project terms. 13. Acceptable Use

You must not:

• submit false, unlawful or deliberately misleading information;
• use the website or support tools for spam, abuse or harassment;
• attempt to bypass access controls, probe for secrets or gain unauthorised access;
• interfere with the operation or security of the website or connected services; or
• use Function Labs services in a way that infringes another person's rights or applicable law.

14. Warranties and Liability

We aim to provide our website, products and professional services with reasonable care. Digital services can nevertheless be affected by bugs, network failures and third-party platforms. Except where a specific written agreement says otherwise, the website is provided on an “as available” basis. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including rights or remedies that cannot legally be excluded.

15. Product Status and Availability

Function Labs develops products through different lifecycle stages including Live, Pilot, Testing, In Development and Coming Soon. Status and availability can change. A waitlist or expression of interest does not guarantee access, release, pricing or a particular launch date.

16. Changes to These Terms

We may update these Terms when our website, products, services or legal requirements change. The latest version and update date will be shown on this page.

17. Governing Law

These website Terms are governed by the laws of England and Wales. Any mandatory rights that apply to you under applicable consumer or local law are not removed by this clause.
